Terms and Conditions for Phonolite

These Terms of Service ("Terms") govern your use of the Phonolite website at https://phonolite.rocks and the Phonolite Obsidian plugin (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Description of the Service

Phonolite is a subscription-based service that provides voice-to-text transcription and AI-powered note structuring for Obsidian. The Service consists of a cloud API and a companion Obsidian plugin.

2. Account Registration

You must sign in with a valid Google account to use the Service. You are responsible for maintaining the confidentiality of your API keys and for all activity that occurs under your account.

3. Subscription Plans and Billing

Free Plan: New accounts receive 10 minutes of transcription per month for up to 3 months at no charge. After the trial period, continued use requires a paid subscription.

Pro Plan ($5/month): Provides unlimited transcription and AI note structuring. Billing is monthly and recurring.

Payments are processed by Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring monthly basis until you cancel.

4. Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then. We do not offer refunds for partial billing periods already charged.

5. Usage Limits

Free accounts are limited to 10 minutes of audio processing per calendar month. Usage limits apply to both cloud and local transcription modes. If you exceed your limit, the Service will return an error until your usage resets at the start of the next month.

6. Your Content

You retain full ownership of your audio recordings, transcripts, and notes. We do not claim any rights to your content. We process your audio and transcripts solely to provide the Service and do not use your content to train AI models.

7. Acceptable Use

You agree not to:
- Use the Service to process audio you do not have rights to
- Attempt to reverse-engineer, scrape, or abuse the Service APIs
- Share API keys in a way that allows unauthorized access
- Use the Service for any unlawful purpose

We reserve the right to suspend or terminate accounts that violate these Terms.

8. Service Availability

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted uptime. The Service is provided "as is" without warranty of any kind. We are not liable for any loss of data or business resulting from downtime or service errors.

9. Privacy

Our Privacy Policy at https://phonolite.rocks/privacy-policy describes how we handle your data. By using the Service, you agree to the Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
